Service
Policies
Posh Web Designs provides web
hosting, email services and domain services. Posh reserves the
right to suspend or cancel any client's access to any portion or all
of Posh services, when Posh deems that the account has been used
inappropriately. Posh reserves the right to refuse service and/or
access to its servers to anyone.
User
Policy
1. Illegal activities.
Posh prohibits sites engaged in:
Illegal activities including, but not limited to, storing and/or
distributing illegal copies of copyrighted software, warez sites,
violations of copyrights and trademarks, violations of U.S. laws,
selling and/or distributing illegal contraband.
Internet abuse including, but not limited to, spamming (unsolicited
Emailing), distribution of mass emailing programs, cross-posting
messages to a large number of usenet groups, posting obscene or
inflammatory messages, threatening other Internet users, mail
bombing Internet users, running packet sniffers or port scanners,
spamming Posh support staff. Systems abuse including, but not
limited to, use of excessive CPU resources, use of excessive disk
space, use of excessive email storage space, hacking our systems,
installing continuously running programs, such as IRC bots,
reselling CGI scripts.
2.Adult content: We
do not allow the presentation, promotion or transmission of adult,
pornographic or obscene images, text or other content. The
determination of what is "adult content" and therefore prohibited
shall be solely made by Posh.
3.Policy Violations:
Should a policy violation occur, Posh reserves the right to
terminate the account without notice and without any refunds. The
policy violating client will be held responsible for any damages to
Posh , including but not limited to, Posh system, servers,
connectivity, reputation, business, service, network, operations, or
equipment. The policy violator may be charged a $500 clean up fee.
Web Site
Content
The client is responsible
for keeping a copy of their most current web site files as backup on
a remote system (not on Posh servers). Posh is not responsible for
any lost files, information, or data. Should any data need to be
recovered, there will be a charge of $100.
Posh does not guarantee to possess the most current copy of a
client's website.
Support
Free customer support is
provided via email and through 1-702-459-POSH (7674). Billing inquiries
will be answered within two business days. Client agrees not to
spam support. Posh does not provide custom programming and
scripting, or web site consulting services as part of our hosting

Payment
Policy and Fees
We do not charge set-up
fees on the Economy sites. Those sites are for you to keep up on
your own. We are not responsible for changes made to the site by
someone other than an employee of Posh. If Posh has to re-design any
or all pages, charges will apply. Ask your designer for details. Set-up fees vary for the
Professional sites: dependant on amount of custom graphics, logos,
and special effects. Ask your designer for details.
The minimum
contract period is 1 year. All services are available in one year prepayment plans.
Full payment is required
before any hosting service is rendered, which includes renewals.
All payment-due notices will be sent by electronic mail. No bills
or invoices will be sent by postal mail or fax. Prepayment is due
each anniversary (six month or one year) following the date the
account was established.
Unlimited
package sites are given thirty (30) days and within those thirty
(30) days you may send unlimited graphics, photos, verbiage, page
set-up, etc.
Once your site is set-up, you are honored
unlimited free text changes
(updates, wording changes, etc.) per month. The addition and
subtraction of pictures is a charge $6.00 per picture. A complete layout change is a charge of $50.00 per page.
Payment Method
Posh accepts only credit
card payments (Visa, MasterCard, American Express) made
through Paypal.com or by sending Cahiers Checks and Money Orders via U.S.
Mail. (Keep in mind, making a payment through paypal will go through
faster, and will ensure a quicker response.)
Refunds
You may
cancel at anytime. If your cancellation is within in 15 days of
your annual payment, you will receive a prorated refund that is
based upon hours of work already invested into your site. Please
keep in mind that your domain name, registration fee and server fee
are never refundable - as you may continue to use our
server without our design services. ($100.00 minimum server fee) We will not refund any fees after
15 days. Refunds will be returned to you within 45-60 days of the
actual day of cancellation.
Payment must be received
or services will not be rendered. If payment is not received on
time the account will be cancelled.
Price Changes
Posh reserves the right to
change prices at any time.
All monetary transactions
will be in $US dollars.
Additional features can be
added at any time (Ask your designer for details.)
Prices are not prorated.
Add-on costs are
non-refundable regardless of whether or not the service was used.
Discounts and Special
Offers
All discounts must be used
up front with the initial quote of the site price. (i.e. if you are
receiving $100.00 off of your site, you are honored $100.00 off of
your annual fee, FOR THAT YEAR. That discount is not applied
to any other work done to the site that requires payment. All Special offers (i.e.
business cards, postcards, magnets, brochures, banners, etc.) are to
be ordered within 30 days of the completion of the web site. NO
EXCEPTIONS.
Renewal
Notification and Billing Schedule
Renewal notification is
emailed to the billing contact seventeen (17) days prior to the end
of the billing cycle.
If Payment is not received
via paypal.com or through the U.S. Mail BY THE DUE DATE the
account will be temporarily shut off until payment is made.
Failure to pay within the following 10 days will result in
cancellation.
Account
Reactivation
If an account is cancelled
due to client request or billing issues and the client desires to
reactivate the account, a non-refundable reactivation fee of $100.00
will be required prior to account reactivation. Accounts are
reactivated after all outstanding charges are paid, including
hosting fees, additional features, and check processing fees. If an
account was cancelled due to policy violation, Posh will not
reactivate the account.
Refund
Policy
If Posh terminates an
account due to policy violation, there will be no refund. Fees associated with additional features are non-refundable.
Cancellation
Posh reserves the right to
terminate service at any time. If an account is terminated for a
policy violation there will be no refund. Posh reserves the right
to delete the policy-violating web site content without notice.
Customers can cancel
service at any time. All account cancellations are to be requested
through the client's control panel AND via email. If the client
requests cancellation, their account will be terminated at the end
of the current billing cycle, or immediately. If the client
specifies immediate account termination, Posh reserves the right to
delete the web site contents without notice. If an account is
cancelled due to non-payment, Posh reserves the right to delete the
web site contents without notice. Should the Posh client decide to
keep the web site content information for re-use, the content may be
purchased at $250.00+, and the content will be forwarded to the new
server and/or web designer. Because Posh does not have a set-up fee,
there are no exceptions to this policy. Designs must be paid for
out-right.
Indemnification
Client agrees to defend,
indemnify and hold harmless Posh against any liabilities arising out
of defective products sold to customers from Posh servers, personal
injury or property damage caused by products or services sold or
distributed from Posh servers, any material that infringes or
allegedly infringes on the rights of a third party available from
Posh servers, and any material that libels or allegedly libels a
third party available from Posh servers.
Disclaimer
Posh is not responsible
for any damages to any client's business. Posh makes no warranties
or guarantees of any kind, expressed or implied for services that we
provide. Use of Posh web hosting and email service is at the
client's sole risk. Posh's services are provided on an "as is, as
available" basis. Posh does not guarantee
that our services will be uninterrupted or error free. Posh will
provide every effort in good faith to ensure that its services are
available to as many Internet users as possible with minimal service
interruptions. In no circumstance will
Posh be liable for any claims resulting from the use or inability to
use Posh's services including, but not limited to, service
interruptions, client errors, Internet connectivity problems,
miscommunications, unauthorized access to Posh servers, InterNIC
problems, DNS caching, Internet bandwidth congestion, power
failures, vandalism, and natural disasters.
Posh Web Designs reserves the right to revise our policies at any
time.
By sending your
payment via paypal, you are agreeing to the terms and conditions set
aside in our policies.
